These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Enfinito (“we,” “us,” or “our”) governing your access to and use of the Enfinito WhatsApp Business API Gateway and related services (collectively, the “Service”).
By registering for an account, accessing, or using the Service, you affirm that you are at least 16 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Access to the Service requires an approved account. New registrations are subject to administrator review and approval before access is granted.
You may register using an email address and password, or via Google Sign-In (OAuth 2.0). You must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
All new accounts (except the first registered administrator) are subject to approval by a platform administrator. We reserve the right to approve or deny any registration at our sole discretion without providing a reason.
Each individual or organization may maintain only one active Enfinito account unless explicitly authorized in writing by us.
You agree to use the Service only for lawful purposes and in compliance with these Terms. You may:

To ensure fair usage and service stability, the following rate limits apply by default:
Exceeding rate limits results in a temporary block (“429 Too Many Requests”). Persistent abuse of rate limits may result in account suspension.
Each account plan has an instance limit (free: 3 instances; pro: 20 instances by default). Administrators may adjust these limits per account. Attempting to circumvent these limits is a violation of these Terms.

The Service, including its software, interface, design, branding, and documentation, is owned by Enfinito and protected by intellectual property laws.
You retain all rights to content you create, send, or receive through the Service. By using the Service, you grant Enfinito a limited, non-exclusive license to process your data solely to the extent necessary to provide the Service.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or extract source code, except where expressly permitted by law.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described therein.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENFINITO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL ENFINITO'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
You agree to defend, indemnify, and hold harmless Enfinito and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
You may terminate your account at any time by contacting us or using the account deletion feature. Termination does not entitle you to any refund for prepaid fees.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for reasons including but not limited to:
Upon termination, your right to use the Service immediately ceases. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
We may revise these Terms at any time. When we make material changes, we will update the “Last Updated” date and notify you via email or a notice within the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
